It’s better to be safe than sorry

We cannot emphasize enough the importance of having a contract where the scope and the obligations of all the stakeholders are clearly understood. Most often, clients do not know what they don’t know and vendors assume a lot – all with good intent. For example, it is often assumed that a client would provide resources as and when required just to find out later that those resources need to do their day jobs too.
It is not a good practice to throw all the work on a legal or a procurement team because they may have little to no understanding of the technology, business context and project goals. This doesn’t diminish the need for the legal and procurement team vetting. Poor contracts do not take too long for the blame game to start.
In our experience, clients are often surprised when we provide our recommendations on an assumingly well-thought contract. We have sat on both sides of the fence.
